TERMS AND CONDITIONS OF THE ONLINE STORE

§ 1

§ 1. GENERAL PROVISIONS

  1. The online store www.lingoria.pl operates in accordance with these Terms and Conditions.

  2. These Terms and Conditions set out the rules for using the Store, placing Orders, concluding and performing Sales Agreements for Digital Products, making payments, delivering Products, submitting complaints, and using services provided electronically.

  3. Every Customer using the Store is required to comply with these Terms and Conditions.

  4. In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law shall apply, in particular:

    1. the Act of 18 July 2002 on the Provision of Electronic Services;

    2. the Act of 30 May 2014 on Consumer Rights;

    3. the Act of 23 April 1964 – the Polish Civil Code;

    4. other applicable provisions of Polish law and, where applicable, European Union law.

§ 2

§ 2. DEFINITIONS

  1. ORDER FORM – the form available in the Store that enables the Customer to place an Order.

  2. CUSTOMER – a natural person, legal person or organisational unit that purchases or intends to purchase a Product from the Store.

  3. CONSUMER – a natural person entering into a legal transaction with a business that is not directly related to their business or professional activity.

  4. BUSINESS CUSTOMER / ENTREPRENEUR – a natural person, legal person or organisational unit conducting business or professional activity in their own name.

  5. PRODUCT / DIGITAL PRODUCT – digital content offered in the Store, including, in particular, educational materials, presentations, PDF files, downloadable materials, and access to or links to digital materials and templates, as specified in the description of the relevant Product.

  6. TERMS AND CONDITIONS – these Terms and Conditions of the online Store.

  7. STORE – the online store operating at www.lingoria.pl.

  8. SELLERSERVICE PROVIDER – Advance Centrum Językowe Sylwia Abramek-Czarnecka, ul. Młyńska 2, 21-080 Garbów, Poland, Tax Identification Number (NIP): 7132910381.

  9. SALES AGREEMENT – an agreement concerning the purchase of a Product concluded between the Customer and the Seller through the Store.

  10. ORDER – a declaration made by the Customer with the intention of concluding a Sales Agreement for a Product with the Seller.

  11. PRICE – the amount payable to the Seller for a Product, as displayed in the Store.

§ 3

§ 3. INFORMATION ABOUT PRODUCTS AND PLACING ORDERS

  1. The Store www.lingoria.pl sells Digital Products, including, in particular, educational materials.

  2. Detailed information regarding the content, format and manner of use of each Product is provided in its description in the Store.

  3. Information presented on the Store's website constitutes an invitation to enter into an agreement. By placing an Order, the Customer makes an offer to purchase the selected Product under the terms specified in the Store.

  4. Product Prices are displayed in the currencies available in the Store. Depending on the selected currency version of the Store, the Price may be displayed, among others, in Polish zloty (PLN) or US dollars (USD).

  5. The final Price of the Product in the selected currency is displayed before the Customer places the Order. Digital Products do not require physical delivery and therefore no shipping costs are charged unless the description of a particular Product expressly states otherwise. Orders may be placed through the Store 24 hours a day, 7 days a week. In order to place an Order, the Customer must read and accept these Terms and Conditions.

§ 4

§ 4. CONCLUSION OF THE AGREEMENT

  1. The Customer places an Order using the Order Form available in the Store.

  2. Before placing the Order, the Customer is provided with information about the selected Product, its Price and the total amount payable.

  3. After the Order has been placed, the Seller sends confirmation of receipt of the Order to the email address provided by the Customer.

  4. The agreement between the Customer and the Seller is concluded in accordance with the information presented to the Customer during the ordering process and in the Order confirmation.

  5. The Customer is required to provide a valid email address that enables them to receive information regarding the Order and access to the purchased Product.

§ 5

§ 5. PAYMENT METHODS

  1. The available payment methods are presented to the Customer during the ordering process.

    1. Depending on the Customer's country, selected currency and the availability of the payment provider, available payment methods may include payment by card, electronic bank transfer, BLIK or other methods offered by the payment provider.

    2. Electronic payments may be processed by an external payment service provider.

  2. The Customer is required to make payment in accordance with the instructions presented during the ordering process. Access to the Digital Product is provided after successful payment, unless otherwise stated in the Product description or required by the selected payment method.

§ 6

§ 6. DELIVERY OF DIGITAL PRODUCTS

Products offered in the Store are digital in nature and are not delivered in physical form. After successful payment, the Customer receives access to the purchased Product in the manner specified in the Store, in particular via a download link, email, Order confirmation page or another method indicated for the relevant Product. Access to the Product is generally provided automatically after payment has been confirmed. In the event of technical problems, the Customer may contact the Seller. The Customer is responsible for providing a valid email address when placing an Order.

§ 7. COMPLAINTS

The Customer has the right to submit a complaint concerning a purchased Product or the processing of an Order. Complaints may be submitted by email to: sylwiaczarnecka6@gmail.com. Customers are advised to provide information enabling the Seller to identify the Order and to describe the problem in their complaint. The Seller shall consider complaints without undue delay and in accordance with applicable law. Nothing in these Terms and Conditions limits the Consumer's rights arising from mandatory provisions of applicable law.

§ 8

§ 8. RIGHT OF WITHDRAWAL AND DIGITAL CONTENT

As a general rule, a Consumer has the right to withdraw from a distance contract within 14 days in accordance with applicable law. In the case of a contract for the supply of digital content that is not supplied on a tangible medium, the right of withdrawal may expire once performance has begun, provided that the requirements of applicable law have been met, in particular where the Consumer has given their prior express consent to the commencement of performance before the expiry of the withdrawal period and has acknowledged that they will thereby lose their right of withdrawal.
Where applicable law requires the Seller to provide the Consumer with confirmation of their consent and acknowledgement of the loss of the right of withdrawal, the Seller shall provide such confirmation in accordance with applicable law. The provisions of this section do not exclude or limit the Consumer's rights in relation to Digital Content that does not conform to the agreement.

§ 9. RULES FOR USING THE MATERIALS

Products offered in the Store are protected by copyright law. The purchase of a Product does not transfer any economic copyrights in the Product to the Customer. The Customer may use the purchased Product in accordance with the terms specified in its description and in these Terms and Conditions. Unless otherwise stated in the description of a particular Product, the following activities are prohibited in particular: reselling the Product or copies thereof; sharing files or download links with third parties; publishing the Product online in a manner that enables unauthorised persons to download it; distributing or presenting the Product as one's own work; using the Product in any manner that infringes the Seller's copyright. The detailed scope of the licence may be specified in the description of the relevant Product or in separate licence information supplied with the Product.

  1. § 10. FINAL PROVISIONS

  2. These Terms and Conditions are governed by Polish law, subject to any mandatory consumer protection provisions that may apply in a particular case. Nothing in these Terms and Conditions is intended to exclude or limit any rights granted to Consumers under mandatory provisions of applicable law. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in force to the extent permitted by law. The current version of these Terms and Conditions is available on the Store's website. These Terms and Conditions shall be effective from August 17, 2026.
